Criminal charges slapped on crew and owner of capsized vessel MB Kim Nirvana-B

MB Kim Nirvana-B capsized off Ormoc on 2nd July 2015, as it headed toward Cebu.  The National Disaster Risk Reduction Management Council, in its final report said that the death toll remained at 61.  Six survivors of the ship along with the Philippine National Police have filed criminal charges against 19 people including the Ship Owner, the Captain and the crew.

Police investigations and survivor reports show that the vessel abruptly turned in waters causing it to capsize off the port of Ormoc.

The Philippine laws indicate up to 40 years of imprisonment if charged and proved of wilful murder.  The Philippine coast guard is conducting a separate inquiry to determine the cause of the mishap.  It is likely that the PCG may recommend criminal and administrative charges.
