A financial servicing firm alleges a vessel did not pay for bunkers and has filed suit for payment.

ING Bank NV filed a complaint on July 8 in the U.S. District Court for the Western District of Louisiana, Lake Charles Division against M/V Charana Naree alleging that the bulk carrier failed to comply with the OW Bunker Group’s Terms and Conditions.

According to the complaint, the plaintiff alleges that it has suffered monetary losses for unpaid bunker deliveries made by O.W. Bunker & Trading to the defendant in a sum amount of $415,898.41 in October 2014.  The plaintiff holds M/V Charana Naree responsible because the defendant allegedly failed to timely pay the full amount of the marine fuels supplied.

The plaintiff requests a trial by jury and seeks an order requiring defendant to pay damages in the amount of $415,898.41, all other damages as may be proven at trial, with prejudgment interest, attorney’s fees, all costs and such other and further relief as may be just and proper.  It is represented by James D. Bercaw, Robert J. Stefani, Len Brignac and Laura E. Avery of King, Krebs & Jurgens PLLC in New Orleans.
