Glencore Faces $6m Claim From Maersk Over Off-spec Fuel

  • Container shipping giant Maersk has filed suit alleging that fuel supplied to it as part of an oil swap deal was contaminated.
  • The suit filed seeks to hold commodities trader Glencore liable for supplying the off-spec fuel to the company’s vessels.
  • Maersk claims an approximate USD 6.1 million in total damages suffered by two vessels.

Maersk Oil Trading Panama S.A. and Maersk A/S (collectively, Maersk) on Friday (5 February) filed a legal suit against Glencore Ltd. (Glencore) seeking to claim an approximate USD 6.1 million (exact: $6,096,276.73) in total damages suffered by two vessels, reports the Maritime Executive.

Via a swap deal with Glencore, Maersk received approximately 24,000 barrels of RMK 700 grade marine fuel from the PetroAmerica Terminal S.A. (PATSA) tank facility at the Panama Canal on 8 February 2018.

The cargo of marine fuel was loaded from the PATSA terminal to the Maersk chartered bunker barge Kollum, which later delivered the product as bunkers to the Maersk Aras and Sofie Maersk.

Damages suffered by Maersk Aras

The 4,664 TEU capacity containership Maersk Aras began burning the fuel on 15 February and suffered a complete engine failure on 17 February.

The vessel had to divert to Manzanillo, Mexico, where she was required to take on an additional 1,100 bbls of replacement fuel in order to continue to trade.

The vessel suffered damages totalling approximately USD 1.90 million. Broken down, the costs translate to $617,153.34 (repair costs), $1,282,398.67 (additional losses and expenses), and $1,459,600.31 (Maersk’s own losses).

Damages suffered by Sofie Maersk

The 9,578 TEU capacity containership Sofie Maersk started consuming the fuel on 1 March and encountered fuel pump issues on 2 March; it experienced main engine failure on 4 March 4 while in the middle of the Pacific Ocean and had to be towed as a dead ship to Honolulu, Hawaii for repair and provision of 2,100 mt of replacement fuel oil.

Total damage suffered by the vessel was approximately USD 4.20 million. Broken down, the costs translate to $2,829,414.17 (repair costs, towage), and $1,367,310.55 (additional losses and expenses).

Presence of contaminants

Following the engine failures experienced on Maersk Aras and Sofie Maersk, Maersk sent bunker samples taken during the bunkering operation between bunker barge Kollum and receiving vessels Maersk Aras and Sofie Maersk, including a dock manifold line displacement sample, to VPS’ fuel testing laboratories in Houston, Singapore, and the United Kingdom for testing.

VPS tests confirmed the presence of numerous contaminants including plastic, fibres, black gum, paraffins, fatty acids, and other components present in the bunker fuel samples.

Maersk seeks total $6.1 million claim from Glencore

The damages suffered by Maersk Aras ($1,899,552.01) and Sofie Maersk ($4,196,724.72) has now led to Maersk seeking a total $6.1 million in damages from Glencore due to alleged breach of contract, products liability in tort, and negligence, stated Maersk’s lawyers.

The legal team is aware of Glencore filing a declaratory judgment action at the New York Supreme Court during 2019; the aim was to seek a declaration that it is not liable to Maersk (either MOT Panama or Maersk Line A/S) under the contract, in tort or otherwise regarding the current legal case.

Despite the fact that the claims asserted by Maersk herein are effectively the mirror image of the declaratory judgment claims brought by Glencore in the state court action, Glencore stated that it would oppose a motion by Maersk to amend its answer to assert affirmative counterclaims in that case,” they state.

Maersk disagrees with Glencore’s position and filed a motion for leave to amend on January 29, 2021.”
