A container ship which left port with a defective navigation chart, causing it to be grounded, was “unseaworthy” for the purposes of the Hague Rules relating to carriers’ liability, reports the Times.
Notwithstanding that the error was a navigational fault by the crew, with the result the shipowners could not claim general average against the cargo interests for the costs of the salvage operation.
The Supreme Court so held in dismissing an appeal by the shipowners, Alize 1954 and CMA CGM SA, against the upholding by the Court of Appeal.
