India’s DGS Formalizes Partnership with NALSAR for Legal and Policy Expertise

The Directorate General of Shipping (DGS), operating under the Ministry of Ports, Shipping and Waterways, Government of India, has formalized a significant partnership with the National Academy of Legal Studies and Research (NALSAR) University of Law. This strategic collaboration, solidified through a Memorandum of Understanding (MoU), aims to bolster legal and academic support within India’s burgeoning maritime sector.

Institutional Support

The MoU, which spans an initial period of three years (extendable by mutual consent), outlines a comprehensive range of institutional support that NALSAR will provide to the DGS in critical areas:

  • Legislative Development and Vetting: NALSAR will assist in the drafting and legal vetting of new maritime legislation, subordinate rules, and regulations, ensuring they align with the overarching framework of the Merchant Shipping Act and other allied maritime laws. This is crucial for keeping India’s maritime legal framework current and robust.
  • Litigation Support and Advisory Opinions: The partnership will encompass the preparation of legal briefs, pleadings, affidavits, and advisory opinions to aid the DGS in various legal matters. NALSAR will also provide support in litigation management and case coordination across different judicial forums, enhancing DGS’s capacity to handle legal challenges effectively.
  • Capacity Building Initiatives: A key component of the MoU is the focus on structured capacity-building. NALSAR will organize and deliver legal training programs, workshops, and knowledge sessions specifically tailored for DGS officials. This will enhance the legal acumen and institutional readiness of the maritime administration.
  • Legal Research and Policy Analysis: NALSAR will conduct in-depth legal research and policy analysis on emerging global maritime challenges. This includes critical contemporary issues such as decarbonization in shipping, the complexities of digital shipping, and ensuring compliance with international naval treaties. This proactive research will help DGS formulate informed policies.

To facilitate this collaboration, eight legal consultants from NALSAR will be deployed at the DGS headquarters. These consultants will receive remote support from senior faculty members at NALSAR, ensuring high-level academic guidance.

Furthermore, a comprehensive Non-Disclosure Agreement (NDA) has been signed. This crucial agreement ensures the confidentiality of sensitive legal documents and international negotiation materials exchanged between NALSAR and DGS throughout the partnership, safeguarding critical information.
