BIMCO reports that it has kicked off a new subcommittee aimed at drafting a Biofuel Clause for Time Charter Parties. This initiative showcases a forward-thinking approach to navigating the legal and operational challenges that arise with the growing adoption of biofuels in maritime shipping.

The Rising Significance of Biofuels Amid Changing Regulations

As frameworks like the EU ETS, FuelEU Maritime, and the forthcoming IMO Net-Zero Framework reshape the industry’s fuel strategies, biofuels are becoming a popular low-emission alternative. However, their implementation brings along new uncertainties, especially concerning fuel quality, engine compatibility, and liability in charter agreements.

New Subcommittee Established to Tackle Key Issues

BIMCO’s subcommittee, which includes shipowners, charterers, P&I representatives, and technical experts, held its inaugural meeting on April 7, 2025. The group’s mission encompasses:

  1. Defining the scope and standards for biofuels
  2. Clarifying expectations around supply, handling, and performance
  3. Ensuring alignment with regulatory compliance

Addressing the Practical Realities of Biofuel Use

The clause will also cover practical considerations for integrating biofuels, such as:

  1. Blending with traditional fuels
  2. Onboard storage requirements
  3. Implications for speed and consumption warranties

These factors are designed to ensure that using biofuels doesn’t hinder vessel performance or create confusion in contracts.

Draft Clause Anticipated by October 2025

A draft Biofuel Clause is set to be presented at BIMCO’s Documentary Committee meeting in October 2025. Once it’s finalised, it will offer essential guidance for both owners and charterers as they transition to low-carbon operations.
