The Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships is set to come into effect on June 26, 2025, marking a significant milestone for the ship recycling industry. However, concerns have been raised regarding potential conflicts with the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal. BIMCO, along with other stakeholders, seeks clarity and assurance from the International Maritime Organization (IMO) to prevent legal obstacles and ensure smooth implementation of the Hong Kong Convention.

Addressing Legal Uncertainties

BIMCO urges the IMO to provide clarification and assurance that shipowners adhering to the Hong Kong Convention will not face sanctions under the Basel Convention. Key concerns include the potential classification of end-of-life ships as hazardous waste and the risk of vessels being arrested for non-compliance during the validity period of the International Ready for Recycling Certificate.

Ensuring consistent implementation of the Hong Kong Convention is essential to maintain industry confidence and uphold environmental standards. Stakeholders emphasized the importance of avoiding conflicts between conventions to facilitate safe and environmentally sound ship recycling practices without the threat of legal repercussions.
