Regulation (EU) 2023/1805, commonly referred to as FuelEU Maritime, officially took effect across the European Union on January 1, 2025. This regulation is designed to cut down on greenhouse gas emissions in maritime transport by promoting the use of cleaner fuels and energy sources, reports Sdir.
Progress on Norwegian Legislation
The Norwegian Maritime Authority (NMA) has wrapped up public consultations regarding the necessary amendments to integrate FuelEU Maritime into Norwegian law. These adjustments aim to ensure that Norway’s maritime regulations are in sync with the EU rules once they are included in the EEA Agreement.
EEA Incorporation Still Unresolved
Norway is working to make sure that FuelEU Maritime is implemented at the same time in both the EU and EEA/EFTA countries. However, the incorporation into the EEA Agreement is still pending. Authorities had previously suggested that this process might be finalised by 2026, with the regulation expected to take effect in the spring.
Possible January 2026 Entry into Force
The NMA has now alerted stakeholders to the possibility that the regulation could be applicable in Norway sooner than expected, potentially as early as January 1, 2026. This update reflects the ongoing developments in the incorporation process, even though some uncertainty remains.
Rationale for Early Notification
In collaboration with the Ministry of Climate and Environment, the NMA determined that it was important to inform affected parties at this stage. A January start date could provide technical and operational benefits for the maritime industry, especially regarding planning and compliance.
Ongoing Uncertainty and Next Steps
While the exact date for the regulation to take effect is still uncertain, the NMA recognises that this ambiguity could create challenges for operators. Authorities have promised to keep everyone updated through official channels as soon as a final decision on the applicability date is made.
