IG Clubs and CDSA Ink SPRO Agreement in China for Ship Pollution Response

The International Group (IG) of P&I Clubs and the China Diving & Salvage Contractors Association (CDSA) have jointly released a Sample Agreement and SPRO Expense Tariff for ship pollution response operations in China. The tariff has been reviewed by ITOPF on behalf of the Group Clubs. These documents aim to promote consistent contractual standards aligned with the latest regulatory updates from China’s Maritime Safety Administration (MSA).

Role and Recognition of CDSA

CDSA is a government-approved, state-level non-profit association specializing in pollution prevention and response. Since 2020, it has been authorized to assess and certify SPROs across China. The association currently includes more than 50 SPROs. Recognizing CDSA’s importance in China’s pollution response infrastructure, the IG and CDSA have worked together—alongside ITOPF—to develop a standard Sample Agreement and SPRO Tariff.

Overview of the 2025 MSA SPRO Template

In May 2025, China MSA released an updated SPRO agreement template that streamlines content by removing sections on liability, insurance, and law and jurisdiction. The revised 2025 version now includes only four brief articles, two of which—on rights, obligations, and termination—are mandatory. The Sample Agreement reflects these mandatory terms and supplements them with additional clauses on legal matters and fee structure, all in line with the IG Guidelines.

Guidance for Contracting with CDSA and Non-CDSA SPROs

Members who are asked to contract with a CDSA-certified SPRO should use the Sample Agreement and Tariff. CDSA will also advise its member SPROs to adopt these terms. If a SPRO outside the CDSA network proposes the 2025 MSA Template without the additional clauses, the Group Clubs recommend that Members request the Sample Agreement terms instead. In cases where the SPRO refuses, Members should contact their P&I Club before proceeding with any agreement.

2014 IG Wording Still Recognized

While the new Sample Agreement is the preferred model going forward, the Group Clubs confirm that the previously issued 2014 recommended wording still conforms to current standards.
