A District court in Yelizovo reportedly dismissed a criminal case against the Captain of a vessel on the initiative of a relative.

What happened?

The Elizovsky District Court of Yelizovo dismissed the criminal case against the captain of the vessel ‘Anatoliy Karyakin’ on the initiative of a relative. The Captain had been accused of being responsible for the death of a sailor during a towing operation.

Accused of violating safety rules:

The Captain had been apprehended by part 2 of Article 216 of the Criminal Code of the Russian Federation (violation of safety rules in the conduct of work, which resulted in the death of a person by negligence).

On June 23, 2017, the tug ‘Peresvet’ was involved in towing the vessel ‘Anatoliy Karyakin’ in the area of the ​​Avacha Bay inside the port of Petropavlovsk-Kamchatsky. The vessel was enroute from the pier of ZAO Petropavlovsk Shipyard to the pier No. 4, located along Ryabikovskaya Street.

The work was supposedly supervised by the captain of the vessel and was towed using a rope that was fastened to a metal ring welded to the side. During the course of the investigation, it was determined that the rod was not a towing device, so it was impossible to attach a rope to it.

Rim breaks from vessel:

When the rescue operation was underway and the tug was negotiating a reverse maneuver when a two-kilogram rim broke off from the side of ‘Anatoliy Karyakin’ and unfortunately struck the head of a crew member of the tug at the head.

Sailor dies of head trauma:

On July 1, 2017, the sailor reportedly died of a trauma in a regional hospital. The relative of the deceased sailor who was also injured during the incident petitioned the court to stop criminal proceeding against the captain citing he had readdresses the damage and had apologized.

Since the court found the appeal of the victim’s relative satisfactory, the captain was cleared off the charges and released.
